Le réviseur d’entreprises se trouve au centre de la controverse entre l’obligation au secret et le droit à l’information, car il se profile comme étant l’homme de la transparence de l’information financière des entreprises et le garant d’une certaine loyauté économique tout en étant expressément soumis au secret professionnel. Ce paradoxe explique les difficultés que peut présenter la définition du secret professionnel du réviseur d’entreprises, et qui font l’objet de la présente étude

Over het beroepsgeheim werden hele bibliotheken volgeschreven en bestaat er een overvloedige rechtspraak. Toch blijkt dat de grondbeginselen van deze figuur niet altijd goed worden begrepen en dat de toepassingen die ervan worden gemaakt, niet altijd optimaal aansluiten bij de bestaansreden ervan. Voor het eerst in de Belgische rechtsleer tracht dit boek systematisch het ‘onkruid te wieden’ om het beroepsgeheim te ontdoen van alle mystiek en (status)symboliek waarmee het gaandeweg werd beladen, om de essentie van de regel te achterhalen. Met de praktische bruikbaarheid van dit boek in het achterhoofd werd de omvang ervan zo hanteerbaar mogelijk gehouden. Net zoals de wettekst zelf vertrekt dit werk van het medisch beroepsgeheim, om dan een algemene theorie van het beroepsgeheim te ontwikkelen. Niet alleen advocaten en magistraten die achteraf moeten aftoetsen of het beroepsgeheim al dan niet terecht werd ingeroepen, ook de ‘noodzakelijke vertrouwenspersonen’ die zelf het beroepsgeheim in hun dagelijkse praktijk moeten toepassen (zoals artsen en advocaten en hun tuchtoverheden, maar ook paramedici, beheerders en ombudspersonen in zorginstellingen, netwerken palliatieve zorg ...) zullen dit werk nuttig kunnen raadplegen om inzicht te krijgen in hoe bewust met het beroepsgeheim om te gaan in functie van het doel achter de regel.

Alors qu’il aura longtemps été la règle en droit administratif, le secret est aujourd’hui devenu l’exception. Le droit d’accès aux documents administratifs est consacré par la Constitution. Les législations relatives à la publicité de l’administration et celle relative à la motivation formelle des actes administratifs fixent les modalités d’application de ce droit fondamental pour le public. Il n’est toutefois pas absolu et le secret reste d’application dans certains domaines. Les hypothèses dans lesquelles le secret reste admis en droit administratif seront examinées, ainsi que le régime des habilitations de sécurité et la confidentialité des pièces devant le Conseil d’État. La directive du 8 juin 2016 sur la protection des secrets d’affaires par Vincent Cassiers, chargé de cours à l’UCL, avocat au barreau de Bruxelles et Alain Strowel, professeur à l’USL-B et à l’UCL, avocat au barreau de Bruxelles. La directive sur les secrets d’affaires harmonise la protection juridique de toutes les informations confidentielles des entreprises. Cette directive équilibre des libertés fondamentales en tension en identifiant des actes licites et des actes illicites relatifs à l’obtention, l’utilisation et la divulgation des secrets d’affaires. La directive comprend impose aussi des mesures et des procédures permettant de combattre les atteintes aux secrets d’affaires et dans le cadre desquelles la confidentialité doit être préservée. La protection des sources journalistiques et des lanceurs d’alerte par Quentin Van Enis, chargé d’enseignement à l’UNamur (CRIDS), chargé de cours invité à l’UCL, avocat au barreau de Bruxelles, membre du Conseil de déontologie journalistique (CDJ). Les secrets se dévoilent rarement d’eux-mêmes. Dans ce contexte, le rôle des journalistes et des lanceurs d’alerte est essentiel pour assurer l’information des citoyens sur des questions qui peuvent les concerner au plus haut point. La présente contribution vise à faire la lumière sur le droit des journalistes à la confidentialité de leurs sources d’information et sur la protection des lanceurs d’alerte lorsque ces derniers décident de révéler publiquement les manquements qu’ils dénoncent.
